Woman Files Slip and Fall Lawsuit Against Publix

SlipFallReport

Nobody is immune from slips and falls. They can happen anywhere and at any time. They can even occur while you’re shopping at your favorite grocery store.

This is what allegedly happened to a Florida woman. She has filed a lawsuit against Publix Super Markets, alleging negligence after she slipped and fell. On May 24, 2023, she was shopping at the Publix store at 6330 West Indiantown Road in Jupiter. She claims that wet and slippery conditions inside the store caused her to fall and suffer severe injuries.

The woman filed a lawsuit against the grocer in the Circuit Court of the Fifteenth Judicial Circuit, in Palm Beach County on June 28. The lawsuit claims that Publix failed in multiple ways to ensure a safe environment for its customers. The woman’s complaint lists numerous breaches of duty by Publix, including failure to identify and correct dangerous conditions such as wet floors. It also argues that Publix did not train its employees to address these hazards. In addition, the woman alleges that Publix failed to place warning signs or cones around the wet areas. Had the grocery store done so, she claims she would not have slipped and fallen.

The woman claims she suffered physical impairment, disfigurement and mental anguish due to her fall. She also alleges these injuries have resulted in substantial medical expenses in addition to lost earnings both past and future.

The woman is seeking more than $50,000 in damages from Publix, plus interest costs and attorney fees. She is looking for compensation for her medical expenses, lost wages, and diminished future earning capacity.

Publix is a chain of grocery stores that is employee owned and operated. It employs more than 255,000 associates in more than 1,300 supermarkets in Florida, Georgia, Alabama, North Carolina, South Carolina, Virginia, Tennessee, and Kentucky. Publix is based in Lakeland and is ranked as one of the top retailers of the century.

Dangers of Slips and Falls

Here are some of the key risks associated with slips and falls:

  • Fractures and broken bones. Common injuries include fractures to the wrist, arm, ankle, and hip. Hip fractures, especially in older adults, can be particularly dangerous.
  • Head injuries. Falls can cause traumatic brain injuries (TBI), including concussions. These can have long-lasting effects on cognitive function and overall health.
  • Spinal cord injuries. A fall can lead to spinal cord damage, which can result in partial or complete paralysis, depending on the severity and location of the injury.
  • Soft tissue injuries. These include sprains, strains, and bruises. They can cause significant pain and limit mobility.
